BA: Sydney Spirit name OK

A disappointing decision, in my opinion, from Basketball Australia in almost endorsing the Sydney Spirit name choice for the former Razorbacks NBL club. WNBL team Bendigo Spirit had complained after having used the name for one full season already before West Sydney adopted the nickname with no awareness that it was already in use by a WNBL team.

Derwin mentions trademarks but it's the 'whole vibe of the thing' - what faith can you put in an NBL club who don't even keep a cursory eye on their partner league to think "wait, the name seems familiar, let's keep brainstorming"!? Plus their logo is embarrassing for the league.

The Bendigo Spirit's fight to keep its name exclusively has fallen on deaf ears after the Sydney Spirit were yesterday given the green light to use the name.

Basketball Australia chief executive officer Scott Derwin released a statement yesterday afternoon on behalf of the interim board of Basketball which had investigated the controversy surrounding Sydney's use of the Spirit name.

''While the Board was sympathetic to Bendigo's objection, given it had not been made aware of Sydney's application to use the Spirit name, it has rejected Bendigo's contention that it would have a negative impact on the team's brand commercially,'' the statement said.

''Bendigo Spirit has cited in its objections the case with the Wildcats as a precedent set by the WNBL, which rejected a name proposed by Christchurch based on the grounds that an NBL team in Perth was operating under the same Wildcats name. It is important to understand that this was in fact based on a legal decision, as the Perth Wildcats had trademarked its name.

''As Bendigo had not registered Spirit as its intellectual property, it has been found that Sydney went through the correct process and received the requisite approvals and initiated the change in its team name in good faith.

Could you imagine another business stealing one of its partners names / identity and not thinking that there is a problem?

IMO the new BA/NBL Board (or whatever they want to be called) do not seem interested in taking the WNBL seriously. I would be interested to see Lorraine Landon's comments on the decision (unless she has been gagged) after the amount of time and energy she has put in to promoting the WNBL. This seems a strange decision given the fact that the WNBL markets itself better than the NBL with a major sponsor and free to air TV. Possibly Bendigo will not take any legal action because it would be too expensive.
Seems a shame, but then who isn't surprised with some of the decisions that emanate from the BA/NBL front office.

Not the best start-up PR for the new club is it...

1. The name is laim anyway
2. Everyone out of the 'know' thinks its a new A-League or netball team out of Sydney.
3. Its already taken... by a basketball club in a national league...?

Yes the name is lame but now the cheer leaders can definitely use "Spirit Fingers" in their performances.

The problem is Sydney Spirit have done everything legally right to obtain/register the name. Therefore BA and the NBL even if they rules the name is Bendigo's and Sydney can't use it Sydney would win in a court of law if they wanted to take it that far and BA would have known it was fighting a losing battle no matter what they thought was right.

I think it's ludicrous and Sydney Spirit should have automatically renegged and issued an apology as soon it became public knowledge that the name already existed elsewhere but nobody likes to admit being wrong.

I can only see it hurting sydney and their current stage that basketball in sydney and as a team. And all this will only further impact negatively on the NBL.

Double Standards - read the article and note the mention of a trademark applying in that Wildcats case.

This is "One Basketball" - it should not get to this. Sydney should have absolutely withdrawn and rebranded.

Maybe BA were prepared to let this through keeping in the back of their minds that after the season the team could be booted with the imminent reform changes.

Forget that the Sydnet crew 'went through the right channels' to aquire the name.... WHY THE HELL DID THEY WANT THE NAME 'SPIRIT?!?!?!?!'
